This Terms & Conditions of Use Agreement (the “Agreement” or “Terms & Conditions”), our Site Posting Terms & Conditions of Use, our Legal Policy, Refunds Policy (see below Section 6. Renewal, Cancellation and Refund Policy), and our Privacy Policy, which are hereby incorporated by reference, governs your use of the SevenLeafCannabisCoaching.com site, products and services (“SevenLeafCannabisCoaching.com”, “SevenLeaf Cannabis Coaching”, Certified Cannabis Coach”, “The Daily MICROdose” or the “Service”). SevenLeaf Cannabis Coaching and its Website SevenLeafCannabisCoaching.com are a service that provides and publishes content about cannabis and wellness infotainment and education. By accessing or using the products, services, website content and software provided through or in connection with SevenLeafCannabisCoaching.com, you signify that you have read, understood, and agree to be bound by this Agreement, our Site Posting Terms & Conditions of Use, our Legal Policy, Refunds Policy, and our current Privacy Policy, whether or not you are a registered member. If you do not agree to any of these terms or any future Terms & Conditions of Use, you may not use or access (or continue to access) the Service.

1. Changes to the Agreement. We may change the terms of this Agreement at any time and without prior notice. If we do this, we will post the changes to this page and indicate at the top of the page the date the Agreement was last revised. CLIENT/USER UNDERSTANDS THAT THE INFORMATION RECEIVED FROM SEVENLEAF CANNABIS COACHING/SEVENLEAFCANNABISCOACHING.COM IN CONNECTION WITH THE PROGRAM, AND/OR WITH THE PREMIUM CONTENT subscription to The Daily MICROdose OR OTHERWISE SHOULD NOT BE SEEN AS MEDICAL, NURSING, NUTRITION or LEGAL ADVICE AND IS IN NO WAY MEANT TO TAKE THE PLACE OF YOU SEEING LICENSED HEALTH PROFESSIONALS, INCLUDING YOUR DOCTOR AND SEEKING YOUR OWN LEGAL COUNSEL TO IDENTIFY AND FOLLOW THE LAWS IN YOUR JURISDICTION.

Client/User understands and agrees that (i) SevenLeaf Cannabis Coaching and any of its Certified Cannabis Coaches are not providing health care, medical or nutrition therapy services and will not diagnose, treat or cure in any manner whatsoever, any disease, condition or other physical or mental ailment of the human body, (ii) SevenLeaf Cannabis Coaching and any of its Certified Cannabis Coaches are not acting in the capacity of a doctor, licensed dietician-nutritionist, massage therapist, psychologist or other licensed or registered professional, (iii) if Client/User is under the care of a health care professional or currently prescribed medications or other medical treatments, Client/User shall discuss any dietary or physical activity changes or potential dietary supplements with his/her doctor, and will not discontinue any prescription medications or other medical treatments without first consulting his/her medical professional; and (iv) Client/User has chosen to work with SevenLeaf Cannabis Coaching and its Certified Cannabis Coaches and participate in The Program and/or use this Website and its content voluntarily.

Client/User should maintain a relationship with his/her primary care physician or doctor. In the event that Client/User does not have one and/or does not have routine physicals, Client/User is encouraged to seek routine medical care. CLIENT/USER WILL NOT DISCONTINUE OR CHANGE ANY TREATMENT PLAN THAT CLIENT/USER MAY BE ON AS A RESULT OF HIS/HER COACHING SESSIONS and/or USE OF THIS WEBSITE INFORMATION WITHOUT FIRST DISCUSSING THE CHANGE WITH HIS/HER DOCTOR.

To the extent any of the information contained in any SevenLeafCannabisCoaching.com product or service may be deemed to be professional healthcare or medical advice, such information is impersonal and not tailored to the healthcare needs of any specific person.

No content or statements used on the SevenLeafCannabisCoaching.com website or in Consultation or Coaching handouts have been evaluated by the Food and Drug Administration. No content or statements used are intended to diagnose, prescribe for, treat or claim to prevent, mitigate or cure any human disease. They are intended for information and education only. Any third party information referred to herein is neither adopted nor endorsed by any other author but is provided for general informational and additional educational purposes. Any person suspecting disease should seek the advice of a licensed physician.

You understand and agree that any SevenLeafCannabisCoaching.com product or service may contain opinions from time to time with regard to wellness ideas mentioned in other SevenLeafCannabisCoaching.com products or services or third party authors, and that those opinions may be different from those contained in another SevenLeafCannabisCoaching.com product or service.

You understand and agree that any given wellness results data is supplied by sources believed to be reliable, that any wellness assumptions in any SevenLeafCannabisCoaching.com publication or service are made using such data, and that such data is not guaranteed by these sources, the information providers, or any other person or entity, and may not be accurate or complete.

3. Registration. In order to access certain features of the Service, you will have to become a paid-in-USD subscribing member of SevenLeafCannabisCoaching.com by purchasing a subscription term and creating a SevenLeafCannabisCoaching.com account. When you create your account, you must provide accurate and complete information, and keep that information up to date. You are solely responsible for maintaining the confidentiality of your user name and password and for any and all activities (including purchases) that are conducted through your account. Further, you are responsible for any fees or charges incurred to your account by accessing SevenLeafCannabisCoaching.com through an Internet access provider or other third party service. You may never use another user’s account without permission.

5. Fees and Payments. If (and only if) you choose to purchase a Program Gateway Consultation, Full Course Coaching or subscribe for one of our online premium content membership products or services that require payment, you agree to pay the full Program fees, subscription fees and any other charges incurred in connection with your user name and password for SevenLeafCannabisCoaching.com (including any applicable taxes) at the rates in effect when the charges were incurred. We will bill all charges automatically to your credit card in USD. Membership subscription fees will be billed at the beginning of your subscription and any recurring renewal. Program Gateway Consultation Fees, Full Coaching Course Fees, annual or other term fees and charges, and monthly fees once billed, are nonrefundable (subject to applicable law). We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance. If you believe someone has accessed SevenLeafCannabisCoaching.com using your user name and password without your authorization, you must immediately notify us via email. You can contact us via the “Contact” link located at the top of every page.

SevenLeafCannabisCoaching.com Premium Content membership subscription to The Daily MICROdose subscription will automatically bill you, including recurring payments according to your subscription choice upon completion of the subscription form.

We may offer a free trial subscription, or free 24 Hour Preview with sign-up from time to time. If you do not cancel your subscription within the free trial or Preview offer period, we will charge the credit card you provided during the sign-up process. You agree to pay the applicable subscription fee and recurring fees as set forth on this site.

6. Renewal, Cancellation and Refund Policy. Your subscription will renew automatically, unless you choose to opt out of the renewal process. You can cancel your renewal subscription at any time by clicking the “My Account” link near the top of any page, choosing the account “subscriptions” tab, and to the right selecting the “cancel” link. When cancelled after billing has commenced and before the next recurring billing, you will continue to have access to the Premium Content of your subscription until the end of the current period for which the subscription was purchased. As previously stated, fees CANNOT BE REFUNDED or prorated. No refunds are provided. If you are unsure if the content will be useful to you, we suggest you purchase only one month first.

7. Code of Conduct. While using any SevenLeafCannabisCoaching.com product or service, you agree not to:

Restrict or inhibit any other visitor or member from using any SevenLeafCannabisCoaching.com product or service, including, without limitation, by means of “hacking” or “cracking” or defacing any portion of the SevenLeafCannabisCoaching.com web site;
Use any SevenLeafCannabisCoaching.com product or service for any unlawful purpose;
Express or imply that any statements you make are endorsed by us, without our prior written consent;

Engage in spamming;
Transmit any software or other materials that contain any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component;
Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of any of the SevenLeafCannabisCoaching.com web site;
Remove any copyright, trademark, or other proprietary rights notices contained in the SevenLeafCannabisCoaching.com web site;
“Frame” or “mirror” any part of the SevenLeafCannabisCoaching.com web site without our prior written authorization;

Only one individual may access SevenLeafCannabisCoaching.com at the same time using the same user name or password, unless otherwise expressly permitted in writing by SevenLeafCannabisCoaching.com.

The right to publish written content on the website is not a part of paid subscription benefits, and publication of material created by users is always at the sole discretion of SevenLeafCannabisCoaching.com operators.

c. You agree not to sell, publish, license, rent, modify, distribute, copy, reproduce, transmit, retransmit, publicly display, publicly perform, adapt, edit, create derivative works from, or otherwise provide access to the Content to anyone, including, but not limited to your fellow employees, friends or family.

d. You agree not to create abstracts from, scrape, frame, or display headlines from our Content for use on another web site or service. Without limiting the generality of this Section, you agree not to post any Content from SevenLeafCannabisCoaching.com to newsgroups, mail lists or electronic bulletin boards, without our written consent.

e. You agree not to use SevenLeafCannabisCoaching.com for any unlawful purpose. If you choose to follow a link to another web site, the terms of service and privacy policy of that web site, not of SevenLeafCannabisCoaching.com, apply. You acknowledge and agree that SevenLeafCannabisCoaching.com shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.

10. Disclaimers of Warranties and Limitations on Liability. 11. General. This Agreement contains the final and entire agreement between you and SevenLeaf Cannabis Coaching regarding your use of SevenLeafCannabisCoaching.com and supersedes all previous and contemporaneous verbal or written negotiations, understandings, or agreements regarding your use of SevenLeafCannabisCoaching.com. SevenLeaf Cannabis Coaching may discontinue or change SevenLeafCannabisCoaching.com, or its availability to you, at any time. This Agreement is personal to you, which means that you may not assign your rights or obligations under this Agreement to anyone. No third party is a beneficiary of this Agreement. You agree that this Agreement, as well as any and all claims arising from this Agreement will be governed by and construed in accordance with the laws of the United States of America, applicable to contracts made entirely within the United States and wholly performed in the United States, without regard to any conflict or choice of law principles. The sole jurisdiction and venue for any litigation arising out of this Agreement will be an appropriate federal or state court located in the United States. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

12. Indemnification. You agree to indemnify, defend and hold the SevenLeafCannabisCoaching.com Parties harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; (b) any allegation that any materials that you submit to us or transmit to our web sites infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (c) your activities in connection with the Service or any SevenLeafCannabisCoaching.com products or services.
